We were approached by a large business who had been trying to resolve a complex grievance involving a member of the leadership team that had reached appeal stage. There was a real risk that the employee was going to lodge an Employment Tribunal and the Directors felt that independent involvement at the appeal stage was needed given the numerous people who had been involved to that point.
Our client had a long serving employee who was doing just enough to ‘get by’ but wasn’t really delivering the performance required by the business. There were low level management issues but it felt that there was never enough for the client to start formal performance or disciplinary processes although many conversations had taken place.
